This Agreement sets out the legally binding terms for your use of the site and subscription to the service. This Agreement may be modified from time to time. The membership and rights of admissions are reserved. Product is a content discovery platform providing access to popular games, videos for the user to enjoy in the subscription period. The Service is for the personal use and entertainment of individual users and cannot be used in connection with any commercial endeavours. 1. Acceptance of Terms of Use Agreement.

In order to use the Mauj product service you must have a valid mobile number with the telecom operator through whom the subscription charges will be collected. The user must consent to the pricing and charging of the subscription charges against his prepaid phone balance or pay for them monthly along with his other telecom charges. This Agreement is an electronic contract that establishes the legally binding terms you must accept to use the Site. For purposes of this Agreement, the term subscriber means a person who voluntarily consents to subscribe to the Mauj Mobile service and pays the subscription charges through his mobile phone bill.

To withdraw this consent, you must discontinue using the site and use the unsubscribe link or send SMS to your telecom operator to unsubscribe the service.

2. Eligibility

a. To subscribe for the Mauj Mobile Products, you must have a valid mobile connection with one of the telcos, as per the laws of India.

b. The Mauj Mobile Products site . is only to facilitate discovery of the games for personal entertainment.

c. By subscribing to the service, you represent and warrant that you have the right, consent, authority, and legal capacity to enter into this Agreement and that you are a registered customer of the telecom operator through whom this service is being marketed

d. You agree to abide by all of the terms and conditions of this Agreement. If at any time Mauj is of the opinion (in its sole discretion) or has any reason to believe that you are in material breach of the terms and conditions of this agreement, Mauj reserves the right to forthwith terminate your subscription and / or your right to use the Service.

3. Account Security.

You are responsible for all activities that occur under your account. You agree to immediately notify us of any disclosure or unauthorized use of your account or any other breach of security.

4. Term and Termination.

a. This Agreement will be effective, valid and subsisting as long as you use our Site .

b. You may terminate your membership at any time, for any reason by unsubscribing from the site by clicking on the unsubscribe link within the product or by sending an SMS message to your telecom operator as has been communicated to you. In the event you terminate your membership.

c. Mauj may terminate your access to the Site and/or your membership for any reason including but not limited to breach of the terms of use, using the service for commercial purpose.

d. Certain provisions of this Agreement including sections 4, 5, 6, 7 and sections 9 to 16, of this Agreement shall remain effective even on termination.

e. Term for the paid Membership would be in accordance with the type of membership undertaken – which is typically a weekly or monthly subscription to the Mauj service. The charges recovered are essentially in the nature of activation charges through which variety of entertainment programs will be provided for viewing/ streaming/ playing games (and not downloading).

5. Non-Commercial Use by Members.

a. Mauj service and any content enjoyed through the service are for your personal and non-commercial use only and may not be shared with individuals beyond your household. During the subscription period, we grant you a limited, non-exclusive no transferable right to access the Mauj mobile service and view and enjoy or play the Games content or video streaming. Except for the foregoing, no right, title, interests shall be transferred to you. You agree not to use the service for any commercial purposes.

b. You agree not to archive, reproduce, distribute, modify, display, perform, publish, licence, create derivative work from, or offer for sale or use except as explicitly authorised in this terms and conditions content and information contained or obtained from or through the Mauj mobile service. You also agree not to circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Mauj Mobile service.

c. Mauj Mobile reserves the right in its sole discretion to review the activity and status of each account and block access to the member based on such review.

d. You hereby confirm that as on date of this registration, you do not have any objection to receive, messages from Mauj Mobile. This consent shall supersede any preferences set by you with or registration done with the Do Not Disturb (DND Register)/ National Customer Preference Register (NCPR). This consent extends to messages or calls relating but not limited to phone number verification, the provision of Gaming service.

e. You are not allowed to transfer the content in any form by any means that is made available to you on the Mauj Mobile product site to any other person under any circumstances.

f. Within the subscription period, you cannot play or watch content more than the permitted number of content within the subscription period.

g. The content on Mauj Mobile that you may have already consumed will not be accessible once the subscription period has ended.

h. Paying of the subscription fee does not give the user any ownership rights on the content that has been watched or enjoyed. The content is only for the entertainment and enjoyment of the user only as long as the subscription is active.

i. You are not allowed to modify any of the content that has been played or watched on the service at any time and doing this shall constitute a material breach of this agreement and the applicable laws of India as it relates to copyright ownership of the content in question

j. You agree to delete all the contents once the subscription period for Mauj Mobile has ended.

k. You agree not to offer this content in any form, to any persons, whether for commercial consideration or otherwise, whether in India or outside.

l. You cannot use any automated processes or any other programs/scripts to download, modify or transfer the content outside of the normal use as provided by the Mauj Mobile service.

m. Mauj Mobile users who subscribe to the service hereby, unconditionally and irrevocably confirm that you have read terms and conditions and agree to abide by them.

n. The license is provided by way of accessing a specific platform over the internet which involves the user to visit the server of ‘Gamesbond’, “ Videovogue” and thereafter stream videos, games, ringtones, etc over the internet. At no point of time, the user becomes the owner of the content and is not authorize to, store, copy the same

o. At no point of time, even during the enjoyment of content, the user becomes the owner of the content or has the possession of the same. It is only viewing license provided to the user in order to enjoy the services available on the platform.

p. The data shall be transmitted through electromagnetic waves and content would be made available to the user on the online platform through such wireless medium

q. License to access the content should be limited to a single user only and user is not allowed to share the same with any other person, family member, friend, etc

6. Proprietary Rights in the Content on Mauj Mobile

Mauj Mobile owns and retains all proprietary rights in the Mauj Mobile product Site and the Service. The Site contains the copyrighted material, licenced content from game and video developers globally, trademarks, and other proprietary information of Mauj Mobile products, and its licensors. You cannot copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Any such act or an attempted act on your part shall constitute a violation of this Agreement and your subscription is liable to be terminated forthwith by Mauj Mobile products. Mauj Mobile reserves right to take legal action (civil and/or criminal) wherever applicable for any violations.

7. Disclaimers.

a. Mauj Mobile assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission of the games to your mobile device.

b. Mauj Mobile is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any mobile site or combination thereof, including injury or damage to Users and/or Members or to any other person’s mobile phone related to or resulting and/or in connection with the Mauj Mobile Service.

8. Limitation on Liability.

In no event will Mauj Mobile be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site or the Service, even if Mauj Mobile has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Mauj Mobile’s liability to you for any cause whatsoever, and regardless of the form of the action, will always be limited to the amount received by Mauj Mobile from the operator in providing this service to the user.

9. Jurisdiction.

If there is any dispute about or involving the Site and/or the Service, by using the Site, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Mumbai, India only.

10. Indemnity

You agree to indemnify and hold Mauj Mobile, its subsidiaries, affiliates, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or any fraudulent act on your part.
